How can copy protection be constitutional?

[via drmblog, 1] Ed Foster [2] writes about copy protection as an absolute immoral, illegal, and unconstitutional intrusion of individual rights. That intrusion has limitations in the Constitution according to that article. So that is where the power of companies, effectively writing their own laws based on power granted from congress, has to find its limitations.
