10th annual report of the Swiss Federal Data Protection Commissioner

Mr. Thür, our SDPC Commissioner, stated [1] a sentence in his annual report I have been waiting for [2]:

On behalf of the fight against terrorism the U.S. try to occur the sovereignty of legislation in liberal countries. According to Mr. Thür this attempt of the influencing control has to be taken quite seriously. He later points out an example regarding the treatment of personal data by U.S. Customs on behalf of flights to the U.S. [4]

So if the airline Swiss passses passenger data to the U.S. Customs it most likely breaks Swiss Federal Law, in that case Data Protection Law Art. 6 [5], since their is no bilateral contract or legislation with the U.S. at the moment.
