I came across the case \”Kelly vs. Arriba\” (Appeal from the United States District Court for the Central District of California Gary L. Taylor, District Judge, Presiding, February 6 2002) [1] while reading the \”Zeitschrift für Immaterialgüter-, Informations- und Wettbewerbsrecht (sic!)\” [2], where Mark Schweizer discusses the legitimacy of thumbnails and inlinelinks.
There are two problems to differentiate; one is about producing thumbnails as used to index and point to remote original images, while the other one is about linking remote images into an own webpage:
The second part of our analysis concerns Arriba\’s inline linking to and framing of Kelly\’s full-sized images. This use of Kelly\’s images does not entail copying them but, rather, importing them directly from Kelly\’s web site. [..] this use of Kelly\’s images infringes upon Kelly\’s exclusive right to \”display the copyrighted work publicly.\” [..] Although Arriba does not download Kelly\’s images to its own server but, rather, imports them directly from other web sites [..] By allowing the public to view Kelly\’s copyrighted works while visiting Arriba\’s web site, Arriba created a public display of Kelly\’s works. [..] Allowing this capability is enough to establish an infringement [..]
Regarding the situation appied to Swiss Law regulations, the sic! article mentions, that regarding the thumbnail topic a solution might be acceptable:
[..] lässt sich für den Sachverhalt, der vom amerikanischen Gericht im Fall Kelly vs. Arriba beurteilt wurde, auch unter Anwendung des schweizerischen Urheberrechts eine Lösung finden, die den Interessen sowohl der Urheberrechtsinhaber als auch der Öffentlichkeit Rechnung trägt. Dies ist zumindest dann der Fall, wenn man ein Bildzitatrecht für grundsätzlich zulässig erachtet und bereit ist, den Begriff des Vervielfältigens im Sinne von Art. 10 Ab. 2 lit. b URG im Lichte der EU-Harmonisierungsrichtlinie einschränkend zu interpretieren.
The possible infringement caused by inlinelinks could be avoid by applying relevant technologies like the ones offered by .htaccess on Apache.
